Special counsel Jack Smith resigned from the Justice Department on Friday, according to a court document. The decision comes amid a legal battle over the release of a special counsel’s report on the events that followed Donald Trump’s 2020 presidential election loss and the alleged mishandling of classified documents after he left office.

Submit the final draft of the report:

Jack Smith submitted his final two-volume report to Attorney General Merrick Garland on Tuesday. Garland has decided not to release the portion of the investigation into classified documents at this time and has expressed the possibility of making it public in the future.

Smith’s office had been in the process of halting its proceedings for several weeks. The resignation was expected before Trump’s re-election as president. In addition to finalizing the report, Smith’s team turned over the ongoing appeal process over the special counsel’s powers to other attorneys and dismissed two criminal cases against Trump.

Court battles over publication:

The first volume of the report could not be made public until Sunday or Monday, but Judge Eileen Cannon ordered the Justice Department to release details of the information in the first volume of the report.

According to the Department of Justice, there is no evidence that the classified documents in the 2020 election portion of the report could affect the case in any way. However, some confidential information will be submitted to Cannon.

Smith’s investigation and Trump’s allegations:

Smith was appointed by Merrick Garland in 2022 to lead an investigation into election fraud and classified documents. He indicted Trump in 2023 during the investigation, but both cases ran into legal hurdles.

In a landmark Supreme Court decision, former presidents have been given broad immunity from prosecution for their actions in office.

Trump took to his social media platforms to criticize Smith while welcoming his resignation. He questioned Smith’s performance, calling him a “failure.”

Garland decided to make the confidential portions of the report available only to select members of Congress, to preserve the confidentiality of the report.

Walt Nota and Carlos DeOliveira, associates of Donald Trump, have claimed that if the report becomes public, it will affect possible lawsuits against them. However, the Department of Justice rejected this claim, saying that the decision to keep Garland’s report confidential was correct.
