Florida Attorney General Investigates Restaurant Over LGBTQ Pride Celebration

Florida’s statewide prosecutor has issued a subpoena for records from a well-known restaurant after it hosted an LGBTQ Pride event last month. The prosecutor’s office claims the event was open to attendees of all ages, despite a recent state law aimed at restricting children’s access to “adult” performances being blocked by the courts.

Attorney General James Uthmeier stated Tuesday that the event at the Kilted Mermaid in Vero Beach featured “adult, sexualized performers in front of children.” His office did not provide details in response to requests for clarification on which laws might have been violated.

The subpoena, issued earlier this month, seeks guest lists, reservation records, surveillance footage, and contracts related to the performers involved.

Linda Moore, the owner of the Kilted Mermaid and vice mayor of Vero Beach—a city located more than 80 miles north of West Palm Beach—has not yet responded to requests for comment.

The controversy centers on Florida’s Protection of Children Act, often referred to as the “drag show ban,” which was promoted by Republican Governor Ron DeSantis. The law targets venues that allow children to attend “adult live performances.” Although it does not explicitly mention drag shows, its sponsor confirmed that drag performances were the primary focus.

Violations of the law could result in fines and the suspension or revocation of liquor licenses, while individuals could face misdemeanor charges.

The law was legally challenged in 2023 by Hamburger Mary’s, a restaurant in Orlando known for hosting drag shows including family-friendly events. The restaurant argued that the Florida law infringed on First Amendment rights by suppressing free speech.

In May, a three-judge panel of the 11th Circuit Court of Appeals ruled 2-1 to uphold a preliminary injunction against the law, describing it as overly broad and vague. The case is now set to proceed to trial in the Middle District of Florida.
